1. Acceptance of Terms
By engaging our consulting services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional agreements or policies referenced herein.
2. Services Provided
Scope of Services: MFG Consultants offers advisory services related to immigration, property investment, and Golden Visa programs. Our services include eligibility assessments, documentation support, property sourcing, due diligence, and post-investment assistance.
No Guarantee: While we strive to deliver accurate and timely advice, our services are advisory in nature. We do not guarantee approval of visa applications, property investments, or any specific outcomes.
3. Client Obligations and Representations
Accurate Information: You agree to provide complete, current, and accurate information necessary for us to deliver our services effectively.
Compliance: You represent that you will comply with all applicable laws and regulations in connection with the services provided by MFG Consultants.
Decision Making: Any decisions regarding investments or immigration matters are ultimately your responsibility. Our advice is intended to assist you and should not be the sole basis for any decision.
4. Fees and Payment
Consultancy Fees: Fees for our services will be agreed upon in a separate service agreement or engagement letter. Any quoted fees are subject to the scope of work and may be adjusted with mutual consent.
Payment Terms: Payments are due as specified in the engagement agreement. Late payments may incur additional charges.
Refund Policy: After a service is engaged with MFG Consultants there will be no refund of the agreed payments.
5. Confidentiality and Data Protection
Client Information: All information provided by you is confidential and will be used solely for the purpose of delivering our services. We take commercially reasonable steps to protect your data.
Third-Party Disclosure: Your information will not be shared with third parties, except as necessary for compliance with legal requirements or as required to execute our services (e.g., partnering legal or financial advisors), and only under strict confidentiality obligations.
Newsletter and Communications: By opting into our communications, you agree to receive newsletters and updates from MFG Consultants. You may unsubscribe at any time following the instructions in our emails.
6. Intellectual Property
Ownership: All materials provided by MFG Consultants, including reports, analyses, and proprietary tools, remain our intellectual property. You are granted a non-exclusive, non-transferable license for personal use only.
Restrictions: You may not reproduce, distribute, or use any materials provided by us for commercial purposes without our express written permission.
7. Disclaimer of Warranties and Limitation of Liability
Advisory Nature: Our services are provided on an “as is” basis without any warranties, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.
Limitation of Liability: MFG Consultants shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services. Our total liability, in any event, shall not exceed the fees paid for the service giving rise to the claim.
Risk Acknowledgment: You acknowledge that investments and immigration processes carry inherent risks, and you assume full responsibility for decisions made based on our advice.
8. Termination
Termination Rights: Either party may terminate the engagement with written notice. In the event of termination, you are responsible for any fees incurred up to the termination date.
Surviving Provisions: Provisions regarding confidentiality, intellectual property, liability, and governing law shall survive termination of the engagement.
9. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction].
Dispute Resolution: Any disputes arising out of these Terms or your engagement with MFG Consultants will be resolved through negotiation. If unresolved, disputes will be submitted to the competent courts in Portugal.
